Terms of use

These terms of use (the "Terms") govern your use of BabyMakers (the "Site"), which is operated by BabyMakers ("we", "us"). By using the Site, you agree to these Terms. If you do not agree to them, do not use the Site.

Information, not medical advice

The Site provides general information and calculators about conception, fertility and early pregnancy. It does not provide medical advice, diagnosis or treatment, and using it does not create a doctor–patient or any other professional relationship. Our medical disclaimer forms part of these Terms.

If you think you may need urgent medical care, call your local emergency number or see get help now for the services where you are.

Who may use the Site

The Site is intended for adults. It is not directed at children under 13, and children under 13 may not use it.

Using the calculators

Each calculator applies a published clinical method to the information you enter, and it names that method and its source beside the result. Results are estimates. They depend on the accuracy of what you enter and on averages that may not describe you, and your clinician may reach a different date or conclusion. Ovulation and fertile-window estimates are not a method of contraception.

Acceptable use

You agree not to:

• use the Site in a way that breaks the law or infringes anyone's rights;
• interfere with the Site's operation or security, or try to gain access to any part of it that is not public;
• send automated requests at a volume that places an unreasonable load on the Site;
• copy substantial parts of the Site's content in order to publish them elsewhere without our permission;
• send us messages that are unlawful, abusive or unsolicited advertising.

Our content

The Site's text, design, graphics and code are owned by BabyMakers or its licensors and are protected by copyright and other laws. You may view and print pages for your own personal, non-commercial use. The clinical methods the calculators apply are published by the organizations we cite, and these Terms claim no ownership of them.

Links to other websites

The Site links to websites run by others, such as health services and professional bodies. We do not control those websites and are not responsible for their content or their privacy practices.

Changes to the Site

We may change, suspend or withdraw any part of the Site at any time. We work to keep its information accurate and current, but we do not promise that the Site will always be available or free of errors.

Disclaimer of warranties

To the fullest extent the law allows, the Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent the law allows, BabyMakers is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your reliance on information or results from the Site. Our total liability for any claim relating to the Site is limited to one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you. Nothing in these Terms limits any liability that cannot be limited by law.

Privacy

Our privacy policy explains what information we collect and how we use it.

Governing law

These Terms are governed by the laws of the state in which BabyMakers is organized, without regard to conflict-of-laws rules, and by applicable United States federal law. If you are a consumer in the United Kingdom or the European Union, you keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in its courts.

Changes to these Terms

We may update these Terms. The last-updated date at the top of this page shows when they last changed. If you continue to use the Site after a change, you accept the updated Terms.
